The Sheriff has a duty to sell the interest in real estate for a fair price given all the circumstances. In order to do this, the Sheriff must be able to ascertain the value of the interest to be sold. To calculate the value of the interest to be sold, it is necessary for the Sheriff to obtain the outstanding mortgage information about the real estate.
The value of an interest in property is calculated by deducting the pay out amounts on any outstanding mortgages over the real estate from the valuation of the real estate obtained by the Sheriff.
