The Department of Justice and Community Safety is responsible for establishing common principles and standards across the infringements system. This entails monitoring and supporting more than 120 enforcement agencies that administer fines in Victoria.
The department’s Infringements System Oversight Unit provides information to help enforcement agencies carry out their obligations under the Infringements Act 2006.
New offences
The Infringements System Oversight Unit (ISOU) must be consulted for all new infringement offence proposals when higher infringement penalties for existing offences are being considered and when existing infringement offences are being reviewed or re-made.
Where a new statutory rule is proposed, under section 6A of the Subordinate Legislation Act 1994, the responsible Minister must certify that the Department of Justice and Community Safety has been consulted and that the proposed statutory rule meets the requirements under the Attorney-General's guidelines to the Infringements Act.
All section 6A certificates must be laid before each House of Parliament with the statutory rule. The Subordinate Legislation Act does not set out any particular form for the certificate that is provided.
Internal review guidelines
The internal review guidelines provide information for enforcement agencies to support the development of consistent decision-making processes and to help to identify the legal and practical requirements of an internal review process. The internal review guidelines are made by the Director, Fines Victoria under section 53A of the Infringements Act 2006.
Enforcement agency onboarding
Fines Victoria is responsible for the end-to-end management of the Victorian fines systems, acting as a central point for the management and enforcement of infringement and court fines.
Enforcement agencies can enter into an agreement to register with or refer infringements to Fines Victoria for management and enforcement. This process is known as onboarding.
